The market resolves to Yes at each threshold if at least the specified number of federal judges are confirmed after July 1, 2026 and before August 2026. Eligible positions include Supreme Court justices, Court of Federal Claims judges, U.S. Court of Appeals judges, and U.S. District Court judges (including territorial courts). Judges for the U.S. Court of International Trade, U.S. Tax Court, U.S. Court of Appeals for Veterans Claims, U.S. Court of Appeals for the Armed Forces, U.S. Court of Military Commission Review, and District of Columbia local courts are not included.
Prediction market odds and traditional polling serve different purposes in forecasting. While polls measure public opinion or expert sentiment at a single point in time, this market aggregates real-money bets from traders with financial incentives to forecast accurately. Prediction markets often incorporate breaking news, legislative developments, and shifting political dynamics faster than periodic polls. For judicial confirmations, market prices reflect traders' assessments of Senate scheduling, procedural timelines, and political will—factors that may diverge from general public opinion surveys.
On Kalshi, this market is priced through an order-book mechanism where buyers and sellers submit bids and offers for contracts tied to specific confirmation count ranges. On Kalshi, prices reflect that venue's order book, liquidity, and how traders price the outcome right now. Traders profit by correctly predicting whether the actual number of confirmations will fall within their chosen outcome bracket. The market price at any moment reflects the balance between bullish and bearish positions, with higher prices indicating greater trader confidence in higher confirmation volumes and lower prices suggesting expectations of fewer confirmations.
This market resolves around Aug 1, 2026, after the conclusion of July 2026. The outcome is determined by the total count of federal judges confirmed by the Senate during that calendar month, verified against credible public sources such as Senate voting records and official judiciary announcements. Once the final tally is confirmed and the resolution criteria are met, traders' positions settle based on whether the actual number of confirmations matches their predicted range.
Several catalysts could shift this market significantly. Changes in Senate composition or leadership priorities may alter the confirmation pace. Announcements of new judicial nominations or withdrawals of pending candidates would affect expectations. Procedural delays, filibusters, or expedited confirmation votes could swing the outcome. Political developments—such as shifts in party control or judicial vacancy urgency—may influence how aggressively the Senate schedules confirmation hearings. Real-time tracking of Senate Judiciary Committee activity and floor schedules will provide the clearest signals for market repricing.
